Sept 11 (Askume) – Alphabet’s Google (GOOGL.O) has been sued over its Gemini artificial intelligence system by a small San Francisco-based artificial intelligence company that claims to have trademark rights to the name “Gemini.”

    Gemini Data, an artificial intelligence company founded in 2013,sued Google in San Francisco federal court on Wednesday night, alleging trademark infringement and unfair competition. It asked the court to ban Google from continuing to use the name “Gemini” and to award Google an unspecified amount of compensation.

    The lawsuit accuses Google of “knowingly and intentionally” trampling on Gemini Data’s intellectual property rights by choosing “Gemini” as the brand for its artificial intelligence system. Gemini Data, which develops an artificial intelligence assistant platform, said Google’s use of Gemini would confuse consumers.

    Google had no immediate comment. Gemini Data and company lawyers did not immediately respond to requests for comment.

    Google last year launched “Bard,” a generative artificial intelligence platform that allows users to interact with human-like information sources. In February, it renamed the system “Gemini.” Google is on a spree to incorporate artificial intelligence into its hardware .

    Gemini Data said it has a federal trademark covering its “Gemini” software. The lawsuit claimed that the US Patent and Trademark Office refused to allow Google to register the “Gemini” trademark because the trademark could be confused with Gemini Data’s trademark.

    “Google, after careful consideration and without hesitation, decided to deprive Gemini Data of its exclusive rights,” the lawsuit states.

    The case is Gemini Data Inc. v. Google LLC, U.S. District Court for the Northern District of California, No. 3:24-cv-06412.
